National Gallery Singapore (collectively known as the “Gallery”, “we”, “our” or “us”) own and maintain https://courses.nationalgallery.sg/ (the “Digital Service”) You may browse, download and copy materials for your personal or educational, non-commercial use, subject to the Terms of Use as stated below.
By accessing and using the Digital Service , you (or, if you are a parent/guardian of a child under age eighteen (18) using this Digital Service, your child) shall be deemed to have accepted to be legally bound by these Terms of Use and our Privacy Statement, incorporated herein by reference. If you do not agree to these Terms of Use, please do not use the Service or permit your child to access or use the Digital Service.
The Digital Service is protected by copyright, trademark and other forms of proprietary rights and restrictions.
The Gallery fully retains all rights, title and interest it may hold in the Digital Service, including but not limited to copyright.
Copyright in the Digital Service on this platform may also reside in persons and entities other than, and in addition to the Gallery. The Gallery seeks to share our artworks with as many people as we can. We are fully committed to respecting the intellectual property rights of others and always use our best efforts to obtain permission for artwork images used. Unless otherwise mentioned, all artwork images have been provided through the courtesy of the National Heritage Board. The copyright of the artworks belongs to the artists or their authorised representatives.
Users are using the Digital Service at their own risk. Under no circumstances shall Gallery or its subcontractors and agents be liable to you or any other person for any direct, indirect, special, incidental or consequential damages arising from your access to, or use of, this Digital Service, including your clicking on any links leading to third parties.
For the avoidance of doubt, the Gallery and its subcontractors, representatives or agents will not be responsible for the third-party links you may click on in the Digital Services, or for any content on the Digital Service which my you may choose to download.
When you access the Digital Service through a mobile network, your network or roaming provider’s messaging, data and other rates and fees will apply. Downloading, installing or using certain services may be prohibited or restricted by your network provider and not all services may work with your network provider or device.
Users are solely responsible for any content they post on the Digital Service, and they shall be responsible for the same.
In using the Digital Service, you shall not post content which does any of the following:
A. contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable;
B. promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
C. infringe any patent, trade mark, trade secret, copyright or other intellectual property or other rights of any other person;
D. violate the legal rights (including the moral rights, rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use and our Privacy Statement;
E. be likely to deceive any person;
F. promote any illegal activity, or advocate, promote or assist any unlawful act;
G. cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;
H. impersonate any person, or misrepresent your identity or affiliation with any person or organization; and/or
I. involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising; and/or
J. give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.
Gallery has the right in our sole and absolute discretion, without notice and without assigning any reason, to monitor and remove, block, edit, move, disable or take any action with respect to any activity or content, and restrict, suspend, or terminate your access to all or any part of the digital service.
The Gallery may modify or discontinue any information or features that form part of the Digital Service at any time, with or without notice to you.
The Gallery may revise these Terms of Use at its sole and absolute discretion at any time and such changes shall be effective and binding on you while you are using the Digital Services. Your continued use of the Digital Service will be considered acceptance of those changes on you.
You agree to fully indemnify and hold Gallery harmless from any and all claims (whether in contract, tort or otherwise), liabilities, costs and expenses, including reasonable attorneys’ fees, arising in any way from your use of the Digital Service, your placement or transmission of any message, content, information, software or other materials through the Digital Service, or your breach or violation of any law or of these Terms of Use.
In the event that one or more provisions of these Terms of Use shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such validity, illegality, or unenforceability shall not affect any other provision contained in the Terms of Use.
These Terms of Use and our Privacy Statement constitute the whole and entire agreement between you and Gallery with respect to the Digital Service and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the services provided on the Digital Service.
All matters relating to this Digital Service and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Singapore, and any claims or disputes of whatever nature shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore.
